I hereby affirm that I am aware that scuba diving and non-scuba diving have inherent risks that can result in serious injury or death.
Risks of diving
I understand that scuba diving involves certain inherent risks, including but not limited to decompression sickness, an embolism, or other hyperbaric/air expansion injury requiring treatment in a recompression chamber.
I also understand that the open water dives required for training and certification could be conducted at a site far from the recompression chamber, either in terms of time, distance, or both. Nevertheless, I choose to proceed with these instructional dives, despite the potential absence of a recompression chamber near the dive site.
I understand and agree that neither my instructors, nor the facilities through which I receive my instruction AustralDivers, nor PADI Americas, Inc., nor its entities, affiliates and subsidiaries, nor any of their respective employees, officers, agents, contractors or assigns (hereinafter referred to as “Released Parties”) may be held liable in any way for any injury, death or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in this diving program or as a result of the negligence of any of the parties, including the Released Parties, whether actively or passively.
Personal responsibility
In consideration of my being allowed to participate in this course (and the optional adventure dive), hereinafter referred to as the “program”, I hereby personally assume all risks of this program, whether foreseen or unforeseeable, that may occur to me while participating in this program, including, but not limited to, those of academic, open water and/or confined water activities.
I further release and discharge said program and the Released Parties from any claim or lawsuit by me, my family, estate, heirs or assigns, arising from my enrollment and participation in this program, including claims arising during the program or after receiving my certification.
I also understand that scuba and non-scuba diving are physically demanding activities, and that I will be exerting myself during this program, and that if I am injured as a result of a heart attack, panic, hyperventilation, drowning, or any other cause, I expressly assume the risk of such injuries, and that I will not hold the Released Parties liable for them.
Legal competence
I further declare that I am of legal age and legally competent to sign this release, or that I have obtained written consent from my parent or guardian. I understand that the terms hereof are contractual and not merely a preliminary consideration, and that I have signed this Agreement of my own free will and with the knowledge that I hereby waive my legal rights.
I further agree that if any provision of this Agreement is found to be unenforceable or invalid, that provision will be severed from this Agreement. The remainder of this Agreement will then be construed as if the unenforceable provision had never been included.
I understand and agree that I am not only assigning my right to sue the Released Parties, but also any rights my heirs, assigns, or beneficiaries may have to sue the Released Parties as a result of my death.
I further declare that I have the authority to do so and that my heirs, assigns or beneficiaries will be unable to claim anything else, due to my statements to the Exempt Parties.

BY THIS INSTRUMENT I AGREE TO RELEASE AND DISCHARGE MY INSTRUCTORS, THE FACILITIES THROUGH WHICH I RECEIVE MY INSTRUCTION (AUSTRALDIVERS), PADI AMERICAS, INC., AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH, REGARDLESS OF THE CAUSE, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER ACTIVE OR PASSIVE. I HAVE FULLY INFORMED MYSELF, AS WELL AS MY HEIRS, OF THE CONTENTS OF THIS RELEASE AND ASSUMPTION OF RISK AGREEMENT BY READING IT BEFORE ACCEPTING IT.
